Double standard: men punished more harshly then women

• If a man did the same, would it be called "underage sex"? No, it would be called rape. So there certainly is a double standard.
• Would a man get away with 5 years? A man probably would get 15 to 25 years in jail.

Sex has more serious consequences for boys then for girls: The double standard should be inverted!

In this modern age boys need more protection then girls (due to slower maturation, existing laws and scientific progress)

• Things have changed since the EEA, where evolution has shaped our inborn moral feelings, and since biblical times, when our religious code was written down. Fairly recently, we devised birth control, abortion, DNA tests, government welfare and legal child support obligation for men.
• In biblical times and the EEA, a girl had no option to avoid pregnancy through birth control, no option to terminate pregnancy through (early term) abortion, no courts nor police state  pursuing the father for support (except shotgun weddings due to pressure by the girl’s kin), no government welfare, no child care and job opportunities for single mothers. And her marriage prospects would have gotten really dim after having an out of wedlock baby.
• Thus, girls and women can have risk-free sex with no long term consequences.
• Boys, on the other hand are totally powerless once a woman got pregnant. Boys/men  have absolutely no chance to avoid the serious trauma of
  • decades of enforced ruinous child support  and alimony duty
  • with no automatic visitation rights to even see the child or influencing how the money is spent.
  • No rights but payment duties enforced by police and prison, not much different from slavery.

Are draconian punishments needed to protect adolescents from their own actions and decisions?

• Anything remotely sexual, indecent touch of adolescents is a heinous crime and deserve decades in jail, vigilante beatings, death penalty?

• Furnishing alcohol to minors is a crime. But it does not carry decade-long jail sentences, nor does it occupy large parts of Interpol, even though it can lead to accidental death, deadly fights, miscarriages and fetuses deformed for life. We also don’t penalize Hollywood movies of adolescents smoking or drinking. Maybe punishments for sexual offenses should be comparable to these.

What damage would be done if government did not meddle in consensual decisions of adolescent teenagers.?

No scientific research is possible when the results are determined beforehand and it is known that certain findings will lead to serious consequences.

There would be very strong legal and psychological argument that the minor has not the capacity to enter into 20 year contracts (especially with an adult!)
  • Maybe impregnating a minor should be the crime, not the sexual act.

If the woman got pregnant, the boy would have to have to pay child support for 20 years, maybe even without being able to see his children. Human-Stupidity thinks that

She was released immediately, on signature bond, while Alan was held on a $1,000 cash bond, which his family could not afford. The disparity in the punishment of these 17-year-olds, both accused of having sex with the 14-year-olds they were dating, goes much deeper. Haasch charged Alan with a Class C felony, which, according to court records obtained by The Daily Beast, carries a maximum prison sentence of 40 years. Norma, on the other hand, was charged only with a misdemeanor, which carries a maximum sentence of nine months in jail.

15 year old (statutory) rape victim boy must pay child support for 20 years

Feminists laws really are complete, in protection of female privilege. A 15 year old boy can not agree to sex, but his life is ruined by child support demands, enforced by jail term threats. Because the adult “rapist” woman did not care about birth control nor decide to abort, the kids life is ruined and his financial and educational future is bleak.

Even if mother cheated, lied, or raped: father always pays child support.

A 15 year old kid never could legally commit to a 20 year lease, or a 20 year installment plan on a house. Why can he agree to be responsible for 20 years of payment for child support?

It is highly doubtful that sex is traumatic or damaging for adolescents (see Rind study).  But would anyone doubt that a 15 year old would suffer great trauma for:

• being condemned to spend major part of his income for 20 years, more then his own age, on child support
• to be deprived of school money, to be obliged to work and unable to go to college, due to child support obligations
• to be obliged to work and to pay child support under the threat of prison terms like in mideval Debtor’s Prison
• Note that a girl can escape the effects of imprudent unprotected sex by opting for abortion, while a man (or underage boy) has no such option to escape his fate as a long term debtor. Note also that it is very common that men are prevented from seeing their children and have no right to decide how their child support money is spent

Jail the majority of the population

Of course, if you check statistics about teenage sexual activities, you might as well arrest half of entire age groups.  Only some rare cases make it to court.  A large percentage of adolescents have sex, and unfortunately even offspring before the age of consent.  Only the unlucky few “perpetrators” get jailed.

One survey found 20 percent of teenagers and 33 percent of young adults aged 20 to 26 said they had sent or posted nude or semi-nude photos of themselves.

So 20% of teenagers are felons for producing and distributing child porn. But many more must be receiving and possessing the files. So probably 50% of teenagers are felons for involvement with child pornography. Add to this sexually active teens who are not covered by Romeo and Juliet laws, and a huge majority of adolescents are at risk for several year long felony jail terms.

Psychological counselling before underage sex, instead of legal harrassment

If the law maker really were concerned with the well being of adolescents, then s/he could demand a mandatory psychological counselling session and a 3 day cool off period before any sex involving a minor.  After that, if both parties still want to pursue the relationship, it should be legal.

She has been charged with sexual abuse of children, possession of child pornography and dissemination of child pornography.

So this girl sexually abused herself, or maybe others of her age?  Conclusions:

adolescents need legal counsel, at all times, on how to deal with ridiculous adult sex laws.

Some common sense prevails. The boy (and the girl) both deserve some serious slaps on the wrist. For drinking!  But, of course, the law is the law. So one  more child (after all 17 year olds nowadays are children, even if they are allowed to drive and to vote) traumatized by the crazy adult legal system.  That is the problem. And, yes, they drank alcolhol. That, of course, is a problem. Maybe the parents of both the 16 year old and the 12 year old should have tought them better and watch them more carefully. And I think the important issue is: did they use birth control or only engage in practices that prevented pregnancy!?

12. How young are kids getting into trouble for innocently “messing around”?

A four-year-old has been charged with sexual harassment for hugging his teacher, and two first graders have been prosecuted for sodomy as a result of innocent, mutual play with each other.

Here are some example cases of young children being formally admonished or legally prosecuted for innocent and playful sexual activity:

  A letter from La Vega school district administrators to the student’s parents said that the boy was involved in “inappropriate physical behavior interpreted as sexual contact and/or sexual harassment” after he hugged the woman and he “rubbed his face in the chest of (the) female employee” on Nov. 10.

  DaMarcus Blackwell, the father of the boy who attends La Vega Primary School, said he filed a complaint with the district. He said that his son doesn’t understand why he was punished.

In 1999 a high school senior in Salina, Oklahoma was arrested for what his mother described to the local media as a “high school thing.”114 He reportedly exposed himself to a group of female freshman gym students on his way to the restroom. [...]

According to the Bureau of Justice Statistics, 23 percent of all sexual assault offenders were under age 18 at the time of the offense. About 3.7 percent were under the age of 12. Indeed, a “detailed profile of offenders in sexual assault crimes shows that the single age with the greatest number of offenders from the perspective of law enforcement was age 14.[...]

Forty percent of the offenders against very young children (under the age of six) were themselves children; a similar proportion (39 percent) of offenders whose victims were age six to 11 were children.229Many sex offenses committed by children resemble the many types of delinquent activities that the juvenile justice system is designed (in theory, if not always in practice) to enable teenagers to outgrow.230 Most child sex offenders do not engage in aggressive or violent behavior. In a study of children arrested for committing sexual offenses, 59 percent of the offenses were categorized as indecent liberties (touching or fondling) and 27 percent as rape. Note that the 27% rape might not be rape in the classic sense, but “statutory rape”, consensual sex among minors.

As one individual who was convicted of statutory rape at age 16 for having consensual sex with his 14-year-old girlfriend told Human Rights Watch, “We were in love. And now we are married. So it’s like I am on the registry for having premarital sex. Does having premarital sex make me a danger to society? My wife doesn’t think so.”255 A mother of a young man from Texas who has to register for having consensual sex at age 19 with his 14-year-old girlfriend noted, “Our family has been devastated by this law that treats a young man in a consensual dating relationship the same as a violent rapist or a predator of young children.”256

The following text has been made popular in Brazilian blogs. It proposes a list of all the precautions a man has to go through before risking to engage in sex with a woman. Other countries are usually even more stringent and have even more dangers, as I will show

Then I will show that the author has been very optimistic and his precautions are way insufficient.

First take the girl to a hospital emergency room and request a blood test for alcohol and other drugs, to avoid charges of sexual contact through fraud with a person unable to consent or resist.(Art. 215 CPB) Then go with her to a notary public and require her to file a declaration that you are practicing consensual sex, to avoid charges of rape. (Art. 213 CPB) Also, demand that she register a declaration with the notary republic that she is engaging in casual sex, to avoid any claim for breach of a stable common law relationship with her partner. (Law 9.278, Art. 7) Next, go to a laboratory and require an examination of beta-HCG (human chorionic gonadotrophin) to make sure that you are not the guy chosen to support it her in a pre-existing pregnancy with a baby that is not yours. (Law 11.804 Art. 6)
At the motel or at home, use condoms and don’t even think of “rough sex” to avoid accusations of domestic violence and get thrown in jail for spousal abuse ( Law Nº 11.340). Also, you should pamper her, praise her, never criticize her or complain about anything, (you must be the perfect mate), so as not to cause any “physical, sexual or psychological suffering and moral damage.” You of course are without any of the same rights in return. (Law 11.340 Art. 5) Upon leaving the motel, take her to the Forensic Medicine Institute and require a medical examination, be sure to request an expedited report for the possibility of bodily injury (Art. 129 CPB) and to check for the presence of sperm in the vagina, to TRY to avoid spending nine months of hell if she later becomes pregnant by another guy (Law 11.804 Art. 6).  Finally, if the presence of sperm in the vagina of the girl is detected, immediately require a collection of samples for further investigation of paternity ((??Law1.060 Section 3 paragraph VI) and request a refund of any alimony obtained through deception or fraud. (Art. 171 CPB)

Having done all this, MAYBE you can practice “safe sex” if you are still interested.

This list is a good start, but unfortunately quite incomplete and left out a lot of risk factors, such as

• underage statutory rape charges
• fake ID
• rape charges due to withdrawal of consent in the midst of the sex act
• jurisdictional problems during travel
• prostitution charges (which soon might elevate age of consent to 21 years)

I attempt to remedy these omissions and elaborate a more complete list of measures

A) Get Legal Counsel to understand the local law

you thought you could have sex without a lawyer? No way!

The girl looks quite clearly underage. Thus ID check, verification for fake ID, study of federal and state law regarding their age differences for application of Romeo & Juliet laws would be of major importance. Also informed consent about the risks, for example that the girl might withdraw consent at any time, a right which probably cannot be signed away in a contract. A lawyer should also advise his client that no photos must be taken, to avoid sexting child porn charges. So the video, though interesting, is very very incomplete.

C) Avoid “grooming” charges.

You can spend decades in jail without ever having met the girl, without ever having tried to have sex with her. Just for chatting her up.

D) Avoid Incest

No genetic consanguinity, nor relatedness by adoption, step-parentship, marriage, etc.

Remember Oedipus? Get DNA test of her and of yourself, to make sure there is no unexpected blood relationship between you,

Oedipus was a mythical Greek king of Thebes. He fulfilled a prophecy that said he would kill his father and marry his mother! He did not know they were his parents. Consanguinity could be caused by mixup of babies at birth. You could be an adopted child, a full brother of your lover, without knowing it. Or she could be the product of artificial insemination with your father’s sperm. Your father could have had a secret affair with your lover’s mother, etc.

J) Is married sex a safer alternative?

By now you are convinced that  it is unfeasible to safely have any short term relationships. So let us analyze if marriage is a safer alternative.

The only risk you reduce is statutory rape. Not only will you have a good background check on the real age of your spouse, but most staturory rape laws have express exemptions for married couples.  But unlike 40 years ago, rape, spousal abuse, domestic violence laws are the same.

There are additional risks and aggravations for sex with wives

• by default, you are the father of your wive’s  offspring. If your spouse cheats on you, the resulting offspring is still your kid, by default.  So you will pay 25 years of child support for the child fathered by your neighbor. In many countries it is prohibited for the  husband “father” to do a DNA test on your own kids. In Britain you can go to jail for DNA-testing your cuckold child.  so you are doomed to pay support for the baby of your wife’s lover
• Most likely, you will pay spousal support for the rest of your life. And if your income decreases so you cannot afford paying, you will be arrested, jailed, lose your drivers license, …
  • you have to pay child support even if you are never allowed to see your kids and have no say over how your money is being spent.
  • allegations of spousal abuse or child abuse can get you kicked out of your own home for good.

Summary & Conclusion: There is no such thing as (legally) safe sex with a woman.

These 27 steps can greatly increase your chances to stay out of the sex offender register, but there always remains a substantial risk. A careful attorney will tell you to avoid sex completely.

Even mainstream ABC TV questions the wisdom, why a 19 year old boyfriend, urged to have sex by his 15 year old girlfriend, should spend his life labeled a rapist? A Turkish court has sentenced a German teenager to a suspended prison term of  two-and-a-half years for sexual abuse of a 13-year-old girl.

As usual, this is where the manipulative lies start. Consensual sexual activity is called “sexual abuse”. Just because it involves a minor. The law distorting facts, worse then any Nazi propaganda. A kiss is a kiss, abuse is abuse. A consensual kiss is not abuse or rape.

Weiss had been detained in a Turkish prison for eight months before being released on bail in December 2007. His attorney had lodged a formal complaint with the European Court of Justice about conditions at the prison, where the teenager was held in a cell with 30 other prisoners and only one toilet.

It is not just Turkey. Even in Germany Teenagers need legal counsel before kissing one of their peers. They need to check ID, consult legal books to make sure they can kiss.

Am I the only one who sees this insanity as total stupid human rights violation of minors.

Weiss maintained that he and the girl became close while in the Mediterranean resort of Side, near Antalya, and one night ended up in the girl’s hotel bedroom where they had physical contact but no intercourse. He also said the girl had lied about her age and said she was 15.

He was arrested the next day, after the girl’s mother filed a complaint with Turkish police, and he was held for eight months in custody until being allowed to return home after an appeal from German Foreign Minister Frank-Walter Steinmeier.

On his return, Weiss wrote a book _ “Marco W. _ My 247 days in a Turkish prison” _ detailing his time inside the jail in Antalya.

Weiss’ lawyer also said he would appeal Wednesday’s conviction, arguing that his client should have been cleared.

“Marco Weiss should have been acquitted, that is what we requested and that is what we will push for,” Mehmet Asim Iplikcioglu said. “We will fight for that until the end.”

In a similar case in 2004, a 24-year-old Turkish bartender was sentenced to nearly five years in prison for the statutory rape of a 14-year-old British teenager who ran away from home to marry him. The two met in 2002 while she was vacationing in the Marmaris resort.

Most sex offenders, says one therapist who works with sex offenders in a state prison system, are “Gentle grandfathers who made one mistake in judgment years ago and fondled their grandchild.

At issue her is:

• Legal punishment for sexual “crimes” against minors is a modern witch hunt.
• Totally out of proportion to damage caused by it.
• Hysteria
• Purposeful confounding of criminal violent sexual crime against minors nearly or totally harmless fondling or consensual sexual acts
• any reasonable open-minded unbiased discussion or scientific analysis of the issue regarding underage sexuality  is totally shunned, repressed, ignored, prohibited.

The blog cited below is pretty extreme. I am not saying that I totally agree with all of this.  It is an interesting “devil’s advocate” article meant to shake up ingrained prejudices.

In spite of being Devil’s advocate, I personally still think that messing with children is somewhat of bad taste and maybe should not be totally liberated.

What I question, though, is if it is such vile a crime as it is being treated by the law in the US and most other countries.

My doubt is:

• Is it really necessary that the punishment for slightly fondling a child is higher then for throwing the same child out of a third story window or throwing boiling water on it and getting the child seriously injured?

Of course among these sex offenders are indeed some criminals who have caused extreme harm: violent rapists of adult women as well as children. A few of them have kidnapped, tortured or murdered their victims.

Dr. Fred Berlin of the Johns Hopkins University Sex Disorders Clinic in Baltimore estimates that such crimes account for less than 1/10th of 1% of all sex offenses in America.

His studies also show that fewer than 10% of child sex offenders re-offend—though recidivism is usually given as a reason for draconian measures against them.

As child abuse experts point out, about 50 children are reported kidnapped and raped or murdered by strangers annually, compared to more than 3,000 children murdered by parents and other family members in non-sexual cases.

Or lonely, geeky gay men—teenagers some of them—who sought mutual sexual release with adolescent boys.

Yet the media, police, prosecutors and politicians continue to insist that children are in dire need of protection from serial rapists and murderers.

Two-thirds of parents surveyed said they feared their children would be kidnapped and or murdered by strangers. Facts simply do not matter when hysteria is involved.
