The entire world’s navies cannot win against a rag-tag "navy" of 3rd world bandits? At sea, where without the typical guerrilla war problems. The bandits cannot hide among the masses. Still they are almost safe.   Human rights sensitivities protect them.

As human-stupidity has noted before, Somali pirates rewarded with asylum in Europe.   Often, Somali Pirates are just released. If they drowned their weapons, and no positive proof can be found, then obvious pirates are just sent home to come back and try again next week We don’t have enough proof to convict in a far away court.

Our human rights laws were not made for Somali pirates. Our human rights laws are well intended, but often ineffective. They often cost us not only money, but cost victimization of innocent upstanding citizens. Of course the cost is exorbitant. Entire navies are there to arrest them. Free flights to Europe. free defense lawyers, and free housing for 5 years in jail. Asylum, welfare, and family immigration to Europe later on. And we all pay in higher merchandise cost for the vastly increased shipping insurance rates.

No wonder many people think that old fashioned methods like summary execution would be much more appropriate methods to nip piracy in the bud. The same way as Guantanamo’s human rights violations probably are saving lives and stemming the terrorist tide.

Late action is another problem. The problem has grown, it is very late. The enemy has become rich and powerful. Now the pirates have good weapons, equipment, good logistics. Similar things have happened in the drug war and with the spam problem. We created the monsters ourselves. Had we acted forcefully beginning, there would be no spam problem. Now the top spammers make millions a month, and enlist the worlds best hackers to aid them.

The beating last month of a 15-year-old girl in the transit tunnel at Westlake Center as security personnel watched without intervening is prompting a review of King County Metro’s policies for its unarmed guards.

The incident — which was partially captured on surveillance video — happened about 7:15 p.m. Jan. 28 and involved a large group of teens and young adults, according to the King County Sheriff’s Office. Another 15-year-old girl is allegedly the one who can be seen on the video assaulting the victim, kicking her head several times while she is on the pavement.

Two security guards stand over the victim while she’s being pummeled and do not intervene. At one point in the video, one guard is seen raising his arm toward the assailant, who ignores him.

A girl gets attacked by a thug girl. Before that the victim had tried to hide behind 3 security guards, to no avail. The guards had orders not to interfere. Even when the girl was on the floor, repeatedly getting her head stomped by the attacking girl. Another guy from her gang robbed the girl’s bag with her iphone and other belongings.

Topic 1: human rights of criminals

If the guards interfered and hurt a thug, they would stand accused of hurting the perpetrator. The guard could face dismissal, ruinously expensive lawsuits, jail.  It is safer for the guards not to interfere. And this is what the official security company policy is.

The academic armchair political correctness human rights & feminist crowd has perverted our justice system.  Redneck country cowboys still have healthy human reactions, but they risk getting jailed.

Topic 2:  Child Porn witch hunt: depicting life threatening violence against children: legal. Depiction of nudity or healthy sexuality: a heinous felony.

Showing an underage girl getting life-threatening stomps on the face, while on the floor, that is normal news cast on prime time TV. Now mere possession of a movie of the same girl posing nude, or, God beware, masturbating, or making love with her boy friend, that would be a heinous crime.  Production or televising such “child porn” would yield 3-25 years in prison.  Criminal violence against children may be shown.

Compare:

• Supreme Court oks indefinite detention for possession of photos. But violent robbers get freed.

• Nude adolescent photos: a Crime. Videos of lynching, killing, beating adolescents are legal Prime Time TV.
• Years of Jail for “clicking on child porn link”. But lynching videos are legal.

Government officials, celebrities and ordinary citizens from around the world have joined international human-rights organizations in a growing campaign against the stoning sentence given to Ms. Mohammadi Ashtiani. She was first convicted on May 15, 2006, of having an “illicit relationship” with two men, for which she received 99 lashes. At a subsequent trial of a man accused of murdering her husband, Ms. Mohammadi Ashtiani was charged with “adultery while being married”. Sakineh Mohammadi Ashtiani is a repeat offender. Already got 99 lashes for “illicit relationship” with two men, and then committed “adultery while being married”. Prof. Farhang, who resigned his diplomatic post over the holding of U.S. hostages in Tehran in 1979 and now teaches political science at Bennington College in Vermont, says the international campaign against the execution by stoning is having an effect.

“You hear two kinds of arguments,” he said. “Some attack the execution just because of the reprehensible nature of stoning. That’s widely heard inside Iran and among Iranians,” he said.

“Others attack the sentence because they’re opposed to any form of capital punishment,” he added. “That’s a more common international sentiment.”

1. What is the logic behind heavy penalties for illicit sexual relationships and adultery?
   In antiquity, When the Bible and the Koran were written, there were no birth control nor genetic paternity tests. Drakonian laws against adultery and pre-marital sex gave men sufficient trust that they were investing their life’s work and effort in their own offspring and not someone elses kid.
   The Koran and the Bible were right, in their times: such laws could contribute to stability of family and society.  Religious dogma and zealotism, unfortunately, prevent any rational modern re-analysis of these topics in the face of birth control and DNA testing.
2. Should people get heavy penalties for illicit sexual relationships and adultery?
   Looking at things from a more rational point of view, I believe there is strong enough motive to prohibit people from having fun and enjoy their sexuality. Emphasis should be on birth control and disease prevention. Interestingly, protests are about stoning, not about being punished with death for adultery. Life in prison for adultery should be ok then?
   Interestingly, there are no strong protests about the 99 lashes for sexual relationships and severe punishment for adultery. Sure, who are we, in Western countries, who give Genarlow Wilson a 10 year jail sentence for having oral sex with a girl 2 years younger then him (see more drakonian punishments in the section about teenage sexuality)
3. Punishment for Aultery?
   If someone enters a marriage contract and swears sexual faithgulness, maybe s/he should be punished for breach of contract. Of course, the problem is that there is no freedom to negotiate the conditions of a marriage contract. Maybe marriage should be negotiable, with open free marriage being an option.
4. Are stoning and death penalty legitimate?
   Maybe we need stricter laws for real heinous crimes by incurable repeat offenders such as violent hooligans, street gangs, bullies who clearly damage their victims and instill insecurity in society. Maybe such people should be executed. Maybe stoning would be very appropriate.

I am aware that there are claims that Sakineh Mohammadi Ashtiani committed other unnamed crimes, but even if this were so, other people suffer similar accusations and punishments.

According to one site, Roozonline, popular with ex-patriot Iranian journalists, there are as many as 15 people convicted of adultery in the same Tabriz courts. They are said to be in danger of receiving the same sentence as Ms. Mohammadi Ashtiani.

Human Rights seems to be mainly concerned with protecting criminals. People who are wrong. You don’t resist a police officer. You don’t shove a police officer. First you put yourself outside of the law, and then you look for protection of the law.

How does a police officer arrest 2 unruly women? If he maced and tasered them, that would be ok? He has to do a profound analysis, if the girls will escalate? How does he know if more people will interfere? Or if one woman has fighting skills, weapons? So a police officer has to take risks to protect the human rights of girls that are clearly wrong and that attack him!?

Interestingly, dictatorships do not have major crime problems. Nor do Brazilian shanty towns dominated by criminal gangs, or cities controlled by the mafia. Most smaller criminals can get subdued by rigorous law and order.

More about the Rodney King Case

I myself have been brainwashed by mainstream political press. Only now, reading up on the case, did I see how much King was wrong. A clear carrer criminal wife and child beater, robber, habitual drunk driving drug addict.

Rodney King’s criminal history played a large role in the high-speed chase that led to his arrest, in his controversial and violent arrest, and in the trials that followed. King explained his decision to flee–at a speed exceeding 110 mph–from CHP officers as resulting from a fear that his arrest for speeding would lead to a revocation of his parole and a return to prison: “I was scared of going back to prison and I just kind of thought the problem would just go away.” Sergeant Stacey Koon, the supervising officer at King’s arrest, concluded (correctly, it turned out) from King’s “buffed out appearance” that he was most likely an ex-con who had been working out on prison weights–and assumed therefore that he was a dangerous character. Finally, it was King’s criminal history that explained the decision of prosecutors to keep him off the witness stand. Why were the cops beating Rodney King? The politically correct answer is: Because he was black. But so were the other men in the car with him, when he was leading the police on a high-speed chase — and none of these other black men was beaten. What was the difference? Anyone who knows anything about police procedures, even if only from watching TV programs like “Cops,” knows that the police often order suspects to lie face down on the ground while they handcuff them behind their backs when they arrest them. That is what the police ordered Rodney King to do. But instead he shook his behind at the cops. They tried to wrestle him down but he was too big and strong for them. They fired electrified darts into him that were supposed to immobilize him, but that didn’t get the job done either. Twice he got up and advanced on the cops. At that point, they had not had a chance to search him and had no way of knowing whether he was armed or not. Arresting a huge, strong, and defiant man is something that most people have — fortunately — never had to do. You might think that this would make observers reluctant to second-guess whatever desperate measures were taken in this situation. But for some people, ignorance simply liberates them from the narrow confines of facts. Even after Rodney King was finally gotten down on the ground, he would not turn face down with his hands behind him, so that the police could handcuff him and search him. In the edited selection of videotape that shocked so many people, Rodney King was still not complying with these instructions. He was trying to ward off the blows — and to get back up — which would have posed a danger both to the cops and to himself. Somali pirates

Elsewhere I had mentioned, that Somali pirates, who were arrested robbing international ships, gain political asylum in European Countries with the rights to bring their families. How come, normal law abiding Somalis don’t get invited to have a new life in Europe?

In 1990, Bavarian actor Walter Sedlmayr was brutally murdered. Two of his business associates were convicted, imprisoned for the crime, and recently paroled. Who killed Sedlmayr? Its a matter of public record, but if one of the men and his German law firm gets their way, Wikipedia (and EFF) will not be allowed to tell you. A few days ago, the online encyclopedia received a cease and desist letter from one of the convicts—represented by the aptly named German law firm Stopp and Stopp—demanding that the perpetrator’s name be taken off of the Sedlmayr article page.

At issue is an apparent conflict between the U.S. First Amendment—which protects truthful speech—and German law—which seeks to protect the name and likenesses of private persons from unwanted publicity.

Human rights became a weapon to protect criminals. German courts convincingly take human rights protection to their logical conclusion. Convicted criminals should have a chance in life to re-socialize, after they get out of jail and finished their punishment.

Would it not be interesting if Walter Sedlmeyer’s heirs were fined or imprisioned for publishing the name of their father’s murderer?

Maybe off-line paper encyclopedias should be burned to expurge history? What about Hitler’s and Stalin’s rights to be forgotten?

Devil’s advocate’s irreverant suggestion

Maybe we should re-think human rights for criminals. Maybe like in old times, criminals should be executed, or permanently marked and mutilated.

Or maybe we should go all the way with human rights and government should employ or financially support criminals for the rest of their life, This is more honest then deceiving citizens into employing ex-criminals  who were given a deceptively clean police record. Some hard labor jobs where they can earn their living but not threaten law abiding citizens would be a good option.

Brazil takes human rights for adolescents to the extreme: underage (under 18 years) criminals can get a maximum of 3 years of “educational measures” even if they killed, raped, and mutiliated many people). And after these three years, their criminal record is wiped clean. So you can do a background check on your new baby sitter or house maid, and get a clean police record, even though she is a multiple rapist and serial killer. This is “human rights” taken to their extreme. It is strange: law abiding citizens have no human rights to be protected from criminals.

Praise the US constitution and the First Amendment.  No discussion in the US about censoring truth. Not a chance.

Of course, on the other end of the spectrum are kids who will be on sex offender lists all life long for having had consensual sex with a 15 year old when they were 17 or 18 year old.

Two German Killers Demanding Anonymity Sue Wikipedia’s Parent

Wolfgang Werlé and Manfred Lauber became infamous for killing a German actor in 1990. Now they are suing to force Wikipedia to forget them.

The legal fight pits German privacy law against the American First Amendment. German courts allow the suppression of a criminal’s name in news accounts once he has paid his debt to society, noted Alexander H. Stopp, the lawyer for the two men, who are now out of prison.

“They should be able to go on and be resocialized, and lead a life without being publicly stigmatized” for their crime, Mr. Stopp said. “A criminal has a right to privacy, too, and a right to be left alone.”

Of course, there is another human rights problem. The problem of innocent white subjects being searched purely for statistical reasons, in spite of not fitting any statistic pattern for terrorists Just for political correctness. That is a violation of their civil rights.

Then poor Lord Carlisle gets himself confused:

So what if statistics show that black people are much more likely to be criminals?  That is racism?

Human Rights, when overdone as a inflexible dogma, encourage crime.

Somali pirates embrace capture as route to Europe

Pirates captured after attacking a Dutch vessel have gone on trial in the liberal Netherlands and at least two of them have declared their intention to stay on as residents.

Geert-Jan Knoops, an international criminal law attorney and professor at the Royal University of Utrecht, has suggested that the Dutch trial might encourage pirates to surrender just in order to seek a better life in Western countries. [ . . . ]

“Life is good here,” said one of the defendants, named Sayid, about his experience in a Dutch jail.

“My client feels safe here. His own village is dominated by poverty and sharia [Islamic law] but here he has good food and can play football and watch television. He thinks the lavatory in his cell is fantastic,” he said.

Mr Ausma has told the Somali that he will be considered for a residence permit after serving his sentence, expected to be a maximum of four years in prison.

“He intends to send for his wife and children as soon as he is released from prison. He knows he cannot easily be sent back to Somalia. He loves it here in the Netherlands,” Mr Ausma told the NRC Handelsblad newspaper.

Mr Ausma has also warned that ongoing piracy trials in the Netherlands, France and the United States will encourage pirates to commit crimes, for the purpose of being captured, rather than deterring attacks on Western flagged vessels.

“Anything is better than Somalia,” he said.

Prof Knoops has called for an international tribunal to deal with Somali pirates.

Maybe the old time solution of sinking pirate ships and letting the pirates drown, or executing them on high seas would be a better service to humanity.  It would be more humane to worry about the safety of law abiding citizens, instead of worrying about the well being of violent dangerous criminals.

Interestingly, nobody worries much about the human rights violation of the average law abiding Somali citizen who was not captured by a foreign navy for being a criminal.

Pirates can claim UK asylum

THE Royal Navy, once the scourge of brigands on the high seas, has been told by the Foreign Office not to detain pirates because doing so may breach their human rights.

Warships patrolling pirate-infested waters, such as those off Somalia, have been warned that there is also a risk that captured pirates could claim asylum in Britain.

The Foreign Office has advised that pirates sent back to Somalia could have their human rights breached because, under Islamic law, they face beheading for murder or having a hand chopped off for theft.

Britain is part of a coalition force that patrols piracy stricken areas and the guidance has troubled navy officers who believe they should have more freedom to intervene.

The guidance was sharply criticised by Julian Brazier MP, the Conservative shipping spokesman, who said: “These people commit horrendous offences. The solution is not to turn a blind eye but to turn them over to the local authorities. The convention on human rights quite rightly doesn’t cover the high seas. It’s a pathetic indictment of what our legal system has come to.”

Pirates must be hunted down and their vessels sunk on sight

Such ships must act promptly and ruthlessly, as piracy will spread unless it is stamped out. The Gulf of Aden is an exit from the Mediterranean, one of the world’s most important seas, crossed annually by thousands of ships. So our campaign must be ruthless and pitiless: pirate ships must be sunk on sight and the crews left to swim to safety, if it can be reached.

Many would complain about such tactics but, in my opinion, pirates have no rights – indeed, it will be vital to exclude human rights lawyers from the anti-piracy campaign. To bring any captives to Europe or America for trial would probably be to grant them their dearest wish, which is to secure entry to a new life in the First World.

Explosives and grenade launchers were discovered on the mother ship when Portuguese special forces boarded “with no exchange of fire”, Lt Cmdr Alexandre Santos Fernandes said.

“It was almost a kilogramme of high explosives. If used correctly it can open a hole in the hull of a ship and sink her,” Lt Cmdr Fernandes said.

“It is the first time we have spotted high explosives on board a pirate ship, normally they just stick to AK-47s and RPGs (grenades).”

The 19 pirate suspects were released because they had not attacked Portuguese property or citizens.

I really wonder if that is furthering human happiness, or if it contributes to more suffering, encouraging further piracy by the same criminals and by others encouraged by their impunity.
